Anyone with a cellphone is familiar with this scenario: You come home, take your jacket off, and set your purse or briefcase down near the door. A few hours later, you get your cellphone out of your bag to use it, only to find that you’ve missed three calls because you weren’t close enough to hear your phone ringing. Cellphones rule in lots of places — we can call for car help when stranded along a highway, find friends in a crowd, and be nagged by co-workers or spouses at any time and place. But the old-fashioned wired phone wins at home. When someone calls your house line, extension phones all over the house ring, and can be used to answer the call. With a cellphone at home, you have to schlep it everywhere you go. RCA Cell Docking System RCA Cell Docking System by Thomson Inc. — $149.99/ www.rca.com As more and more households continue to trade in their landlines for cellphones with better calling plans and free long distance, the inconvenience of toting a single cellphone around the house gets more annoying. So, this week we took a look at two products that aim to solve that problem by tying your cellphone into your wired home phone setup. They allow you to use your home phones, including extensions in every room, to place and receive calls through your cellphone and your cellphone calling plan. The two products are the RCA Cell Docking System from Thomson Inc. and the Dock-N-Talk Universal Cellphone Docking Station from Connecticut-based Phone Labs Technology Co. Each costs $150. Both work by directing your incoming cellular calls to a wired phone — and allowing outgoing calls to be made through your wireless network using these telephones. The RCA product comes with a special cordless telephone that links to a cellphone docking station, while the Dock-N-Talk is a small box that connects any corded or cordless home telephone to your cellphone. To use the RCA system in multiple rooms, you need to buy additional cordless handsets for $70 each that work with the RCA system.
Planning Homecoming to be Successful
Homecoming can be an event that will bring the community and the school together. However, it must be planned appropriately. Homecoming is a huge event which the whole community often helps put on for high school students. While it is mainly for high school students, homecoming is also often a town event as everyone takes interest in their local basketball or football team. Due to the interest that the community takes in the school around this time, it is a good time for school faculty and students to reach out to the community and build relationships. The better the relationships that a school builds with the community, the more support it will receive. The most common events associated with a homecoming celebration include the home basketball or football game, activities for students and alumni, a parade through the town that includes the high school’s marching band, the coronation of a Homecoming Queen and King, and of course the big dance. There a many ways that a school can use these events to gain favor in the community. For example, you can offer the alumni opportunities to contribute or give back to the school. Featuring the talent of the marching band in the parade can encourage people to volunteer donations to support their group. In addition, the parents must get involved to help chaperone the dances. Other events will be open the community and to students, at which you can advertise a variety of upcoming events such as school plays, fundraisers, and musical performances. The closer your community is, the more exciting your school events will be. For example, a united community who enthusiastically supports their football team can make a particular game very exciting. As everyone yells and gets excited throughout various parts of the game, it can become a very thrilling experience. One of the elements that makes homecoming special is how much school spirit that is typically shown around this time. There are many things you can get the community involved in. For example, a local bowling alley may want to sponsor a free bowling night for those who attend the dance. Other local companies may want to sponsor elegant limousine transportation between the dance and the bowling alley or other attractions. A limousine company itself may want to sponsor this transportation as students will connect the limousine ride with a very fun event and it will encourage them to rent a limousine the next time they go to a fancy dance. It can be a great opportunity to advertise while supporting a great cause, but many companies do not realize it. With a little advertising and planning, all of these things can come together for the benefit of everyone in the community. You may want a school business class to be in charge of this assignment as it is something these students will be dealing with in the future, if they continue on the path to become business professionals. In addition, the extra conveniences offered by business will be something that students remember for the rest of their lives. The key to putting on a good homecoming is good planning and coordination of all efforts. The promotion of a positive environment is critical to school support and homecoming is one of the events that can promote a positive environment. In a typical high school, there will be a happy chatter and buzz as girls dress up and wonder if they will get asked to the dance. Girls must plan how they are going to do their hair, what dress they will wear, and how they are going to do their makeup. Boys must plan the evening’s dinner, get a corsage, and rent a tux. Many obliged. Many girls spotted corsets and feather boas that added sophistication to the party. “The night was about tease and seduction and we wanted that to show through the clothes,” said the CEO of the magazine, Liz Kakooza. “We wanted to bring out the sexy and naughty side of a woman without looking trashy,” she added. The magazine will be having the official launch in March. “We want to add our voices to the fashion environment in Uganda. We will do that through the magazine that will not only talk about fashion but cover other topics too,” said Kakooza. Free drinks and cocktails flowed till midnight with many having too much to drink. “Its hard spending the whole night standing in these high heels let alone doing it while drunk and be expected to dance the night away,” lamented one reveller.

The three-hour drive south from India’s capital New Delhi, India, to the city of Agra was quite expensive. Even more disconcerting was the queue, which stretched the entire breadth of the wall around the Taj Mahal, although it took me a little less than one hour to get in. Yet the sight of one of the eight wonders of the world, a piece of architectural finesse whose beauty has apparently not been surpassed to-date, quickly made up for all the hurdles that we went through to get to it. After we entered through the forecourt (the Chawk – I Jilau Khana), whose calligraphic inscriptions of Qur’anic lines are fascinating in their own right, the sight of the bright marble structure immediately, almost magnetically, drew our attention. It was breathtaking. The Taj Mahal (meaning Crown Palace) is regarded as one of the eight wonders of the world. It was built by a Muslim Emperor called Shan Jahan (died 1666 C.E.) in memory of his dear wife and queen, Mumtaz Mahal, who died giving birth. It houses her grave at the lower chamber. The grave of Shah Jahan was added to it later. And yet, according to literature about the Taj, the sight of the mausoleum during the day does not show its intrinsic beauty. By night, the Taj apparently seems to glow in the light of the full moon. And on foggy mornings, it seems suspended when viewed from across the Jamuna River. I did not get to see either of these sights, but what I saw was well worth everything it took me to get there. Between the forecourt and the Taj Mahal is a garden partitioned into 16 well-manicured lawns. The paradise garden is split into four by a pool called the Celestial Pool of Abundance. As we walked past the thousands of people that visit the site daily, the serenity inside was a stark contrast to the chaos outside. Just before we reached the gate to the Taj, our driver issued a series of instructions. “No talking to anyone; just walk straight. No paying to get ahead of the queue. No eating anything,” he said. We would soon find out why. As soon as we stepped out of the car, leaving our driver to find parking space, a man came claiming he worked for the tourist travel company that had transported us. “I am your tour guide. You don’t have to pay me anything,” he emphasised. Our protests to be left to find our own way fell on deaf ears. Shortly after, the “tour guide” changed his story. He now claimed he was employed by the government to help foreign tourists. We stuck to our guns, maintaining that we were fine by ourselves. Nevertheless, he followed us. After we bought our tickets, the “tour guide” tagged along, now promising that he could help us jump the long queue – but this time at a fee. The offer was tempting, but still we didn’t fall for it. Perhaps expecting us to lose our resolve at some point, he hung around, occasionally reminding us that there was a better option. He eventually gave up. When we reached the front, we witnessed how people “beat the queue,” when a man suddenly joined it ahead of us. My protests that he should go and start at the back fell on deaf ears as everyone looked on indifferently. Finally, a young man who had engaged us in conversation finally said, “Leave him alone. This is India.” We got the message and kept quiet. For a site that charges foreign visitors more than 35 times that of locals, it was disheartening that there were no proper tour guides to help visitors walk around the site. Instead, all sorts of unscrupulous characters have been allowed to take charge of the place, many masquerading as tour guides and security officials. One can only imagine how many tourists have fallen prey to these people while the Indian government and other entities charged with administration at the Taj Mahal look the other way. Both outside and inside the Taj Mahal e is a level of disorganisation that somehow betrays the image of a monument that was constructed with such finesse. Outside the high wall fence, the walls are wearing off. The grass has dried up too, leaving a dirty, dusty compound where just a little more organisation could have resulted in better manicured surroundings. Inside the site, there are no signs to direct people or provide information about the Taj.
Pool house: A haven of relaxation
The importanceSwimming pools have become a common feature in many homes and accommodation set-ups. Gone are the days when swimming could only be done in specified hotels or apartments. However, with swimming becoming a sport, an exercise and a way of unwinding, pool houses too are a necessity today. There’s need to have this facility put up by all swimming pool owners. So what exactly is a pool house? The importance According to Sarah, an administrator at Davis and Shirtliff , a pool house is a shelter constructed to protect the swimming pool pump and filter from sun heat and rain water. “It is basically like a house put up with the purpose of protecting the pump and filter. It is a necessity as long as you have a pool, but if there are any limitations to constructing one, you can actually use one of the rooms in your house,” she says. However, this particular room must be used to solely protect the pump and filter to prevent the breakdown of the filtration and pumping system. Storage purpose A pool house can also be used as a store, a storage space for pool equipment. Many times pool equipment is kept in the general storage area yet they are delicate machines. Such equipment needs a separate storage unit and that is why a pool house can play this role thoroughly well. Changing room The pool house too can act as a changing room or entertainment centre. This can be achieved by putting up a room above the pump shelter or side rooms to play the desired role, thus it is as well a discreet spot to towel off, change and use the bathroom. In such an instance, it mainly serves the role of a changing room where undressing and re-dressing up is done before and after swimming respectively. Entertainment centre A pool house can have side rooms or another room above the pump shelter to act as an entertainment centre particularly for those who come around to swim. An entertainment hall includes music and resting chairs, among others thus creating a good ambience for the users. For some pool owners, they design it to act as a poolside bar where you entertain friends and family. If you need it for such a role, it is designed in form of a shade-like structure to create a shelter that creates a conducive atmosphere for drinking with friends. Materials used Pool houses can be made with reeds and red cedar. When constructing one, use non-corrosive hardware metals and equipment to ensure no rusting. Equipment like nails should be stainless steel and premium materials last even longer. Other materials used when setting up a pool house are cement, concrete, blocks, stones, sand, tiles and iron sheets. Ensure proper ventilation while constructing to allow for proper aeration of the room. Also, pool houses must be constructed at the lower end of the swimming pool so as to enable proper flow of water below gravity. “The water should flow down into the pump so that it is pumped into the filter for cleaning and after filtration, it is pumped back into the pool. This is why the equipment that is stored in the pool house must be on the lower end of the swimming pool.” Pool house construction can be easier accomplished and at a cheaper cost if it is carried out along with the swimming pool construction. However, if constructed independently, it is often more expensive. The cost “Most of the quotations we get at Davis and Shirtliff cost Shs5m. This is a fair price for pool house construction but it is cheaper if the construction is carried out along with the swimming pool to minimise costs,” Sarah says.

Windows having a high efficiency and a good thermal insulation system can be used to reduce energy waste. For instance, you can use sunlight to light your office during the day without using hydro electric power bulbs. Alternatively, you can use a solar panel to light your bulbs. Using hydro electric power in this case is not being green. When it comes to outdoor lighting, high efficiency LED and induction lamps, ultra- efficient electronics and centralised intelligent control systems can be used by cities to reduce energy use up to 70 per cent. Also, by replacing incandescent traffic signals with LEDs can significantly reduce cities’ traffic signal energy use up to 90 per cent. Mr Kabandize says that embracing the outdoor living space like verandahs, patios and gazebos (outside open huts) is good idea. Water conservation Reduction of runoff water, quality improvement and minimising water use is one of the green building techniques. If you plant grass in your compound, you save a lot of run-off water contrary to one with an all concrete cast compound. Using eco-san toilets to replace flush toilets is a way of saving water. All these contribute to a green building. Materials usedGreen building materials are those materials that are considered to be renewable. For instance, bamboo due to its fast growth rate and others like straw and lumber (wood ready for use). Also, the use of recyclable material is encouraged, for instance, using timber and demolished debris. Environmental quality The quality of the air within the building should be free from volatile organic compounds hence improving the indoor air quality. This can be achieved by building and cleaning your home using materials with little or low emissions. Waste management A green building should have minimal waste from occupants. This can be attained by giving on-site solutions for excreta. For instance, garbage pits for kitchen refuse and soak pits for grey water. This helps to reduce the load on municipal treatment plants and landfills. House locationLocate your house in an area that doesn’t need tampering with the existing landscape and surrounding natural features. Also, one can plant flowers and shrubs that consume less water. Their benefits We can also ask ourselves, what are the benefits of green buildings compared to conventional structures? Low life cycle costs A study showed that, an initial increment in the first costs of approximately two per cent of green design, will give a life cycle saving of greater than 10 times the initial investment, or 20 per cent of total construction costs. Good health Since the materials used in green buildings are often natural materials, less or no emissions are given off compared to manufactured materials. This gives better health to occupants with no sicknesses and allergies. Cost effective design A well-planned integrated green design will give a saving in energy by 25-30 per cent. Design systems like building orientation, natural ventilation, natural day lighting and onsite renewable technologies reduce energy consumption hence reducing costs significantly. Better environmentBy using environmentally friendly materials and strategies for construction, environmental pollution is reduced. Also, resource sustainability is guaranteed because using eco-friendly systems like planting grass compounds, composting, recycling and afforestation are used. One of the sensitive issues about green buildings is the price. The initial cost of erecting the building is often high compared to the conventional ones but the long term running costs are always less hence saving a lot in the long run. With such benefits, setting up a green building would will be beneficial to both our economy and the environment.

Green structures have been adopted purposely to minimise wastage of existing scarce resources like water and energy, eradicate environmental pollution and degradation that causes diseases. Also, it safe guards the health of the residents in those buildings. This is contrary to the concepts that are used in constructing our conventional buildings, that is to say, being economical, attaining utility, being comfortable and increasing durability of the structure.Although the concept of green buildings is slowly being adopted in Uganda, in other countries like Australia, United Kingdom, United States of America and Switzerland, the governments are already advocating for them and laws are in place to guide the construction of these buildings.
In India, the Green Building Council exists. In United States of America, the International Green Construction Code is one of the codes used, in Italy, the Green Building Council also exists. These codes came in place due to high environmental pollution, environmental degradation, and lack of sustainability, among others.

On the Move Design students inject fun into the TTC
OCAD University's Design Competition, presented by the Faculty of Design, is an annual event wherein interdisciplinary teams of 3 to 6 students are presented with a design challenge — usually a real-world issue — and over the course of an extended weekend asked to respond with their solutions. Faculty advisors with expertise relating to the challenge are on hand on Saturday to answer questions about concepts and technicalities, and students must present their designs by the end of day on the following Monday. Many OCAD U graduates cite the challenge as one of the most important experiences in their time at the university. This year’s challenge, On the Move, posed the question, “How do we make the TTC experience better?” The challenge’s brief stated: Enormous amounts of energy, money and brain power are invested in improvements that often fail. Cars are designed to go faster, while speed limits are enforced and roads are jammed. By contrast, a few innovative ideas have proven truly inspiring. TTC has just fewer than 1.5 million riders per day — 200,000 per day at Bloor station alone — totalling more than 471.2 million riders in 2009. And yet, only 29 percent of Toronto-area residents leave their cars at home. Design a way of improving the TTC experience. Show the impact your idea would have on Toronto public transit riders and staff through a short movie. Your options are wide open for design proposals. They can include: installations, campaigns, interior redesigns, design activism, system redesigns and more. Be ambitious, creative and playful. It is important to note that any positive experience should be one that reaches as wide and inclusive an audience as possible; therefore, bear in mind the ways in which your creative approach could have maximum impact on that wide target audience, and how you may affect them.

Taking the fair into this new era, Julien Frydman has been appointed Director of Paris Photo. He was head of the renowned photography agency Magnum Photos in Paris since 2006, and has been a consultant of the LUMA Foundation for Le Parc des Ateliers in Arles since January 2011. He takes over from Guillaume Piens who ensured the success of the fair for the last three editions. The 2011 edition will mark the 15th anniversary of Paris Photo. Artists and their work, dealers, and publishers, will enjoy an exceptional environment to show photography in all its diversity. This year's edition will turn the spotlight on African photography, from Bamako to Cape Town. As with the previous years, the selection committee, made of eight international galleries, will guarantee the quality of the galleries and works exhibited, offering a unique panorama of nineteenth-century, modern and contemporary photography. In design, those ambitions came to a head in 1951's Festival of Britain. The idea of celebrating the centenary of the 1851 Great Exhibition had been in the air for some time. In 1946 Misha Black drew a fantastical plan for the South Bank site, exhibited at the Cubitt, that makes it look like the Crystal Palace reinterpreted by the creators of The Jetsons. It's a somewhat tongue-in-cheek proposal, you suspect, yet it evokes a time when London was prepared to dream. In the end, Black was one of the co-ordinating architects for the (much more sensible) Festival, and his patch included the Dome of Discovery – the radically modern but short-lived precursor to the Millennium Dome, in which the DRU designed an exhibition celebrating British scientific and creative discoveries.
Clifford Hatts was drafted fresh out of the Royal College of Art in 1949 to work on the exhibition. He recalls that he and his DRU colleagues were divvied up into "flat boys", or graphic artists, and "round boys", the architects and product designers. "Our brief was exactly what it said on the tin: present British discovery in a simple, straightforward way," Hatts, now 88, told me. He decided not to visit the Millennium Dome 50 years later because, with its vague exhibition, it seemed to lack the sense of purpose of its predecessor. "Design was written in big letters in those days – it was all about turning our backs on the war."

Laura Oldfield Ford
This month Oldfield Ford's work has been cropping up around Bristol city centre's Broadmead area in Poster Sites, a project commissioned by Arnolfini. A recent mall development nearby is promising new money to the neglected shopping district, but her posters suggest capitalism is an empty dream. Window displays flaunt images of interior design offset by the huddled homeless, while people absent-mindedly wander shopping arcades, haunted by pawn-shop ads. A banner of dates running from the 14th through the 21st century tops each poster, pointing to past revolutions, riots, stock-market crashes and energy crises and implying similar events are coming back again in the not-so-distant future. Why we like her: London 2013: Drifting Through the Ruins, exploring what's to become of the Olympic site and its surrounds, is a particularly sharp imagining of abandoned ideals. Having a laugh: An encounter in Bristol's Broadmead Shopping Centre is said to have inspired comic Matt Lucas to develop Vicky Pollard, his infamous mouthy teen character. Where can I see her? At Poster Sites throughout Bristol city centre until 28 February. Her work is also in the group show Told at Hales gallery, London, from 25 February until 2 April. Finally, she's included in Orbitecture at Grundy art gallery, Blackpool, until 12 March.
Light is right at the Brit Insurance Design awards 2011 today
The only object in the exhibition that stands out as a potential overall winner is in the product design category: the iPad. So successful has this game-changing piece of technology been that it should have its own category – indeed it pretty much does, since most of the entries in the interactive design section are apps for the iPad, displayed on iPads. But it's possible that the judges will avoid the obvious, popular, zeitgeisty choice and stick it to Apple – especially since one of the judges confessed, to me, "I don't like the internet". I rather liked Ingo Maurer's Flying Future hanging light, a diaphanous membrane inserted with organic LEDs (OLEDs). So energy efficient that they last almost indefinitely, these films of organic semiconductor are the light source of the future. They hold the potential for light to be treated as a material in itself, like cloth, draped as luminous surfaces. With the relentless march of digital technology, the graphic design section of the show seems to be retreating into a world of nostalgia. It is wonderful to see the beauty of printed books reasserted, though I wondered why so many of those here are new editions of 18th- and 19th-century novels. Ironically, the work that jumps out here does so because it's miniscule (and, yes, light): Irma Boom's Boom. The most respected book designer in the world has produced a 704-page catalogue raisonné of her work, but it's just two inches high. One doesn't see that kind of modesty often. Or perhaps it's not modesty at all, but mystical devotion to her craft. The book is reminiscent of one of those medieval miniature Qur'ans written with a horse's hair. Of all the disciplines, lightness is most a virtue when it comes to transport. For all the talk of electric cars and high-speed rail, we are realising now that only by reducing the weight of our modes of transport so that they consume less energy can we make them more sustainable. Here, there's another clear winner: an aluminium bicycle by Dutch brand Vanmoof. I'll take it any day over the YikeBike, an electric penny-farthing that could have been designed by HR Giger and appears, like some Sinclair C5 of bikes, to be dead on arrival. The fashion category is anyone's guess. There's a reason why the Design Museum calls on an international panel of experts to nominate all the entries, and that's because design is a bewilderingly broad field and no one's an expert on all of it. As a show, it's hit and miss and there may be no agenda, but I recommend you go and see it. There's bound to be something there that will surprise you.

Many people also opt to have water and lighting equipment stored for these eventualities, as well as cooking supplies. There is no real limit to what can be arranged, but there is a given set of things that can be arranged in order to make sure that the elements that are stored are useful and practical to have around. Concerned about the potential disruption that would be created by enforcing the new rules, the administration has granted dozens of additional waivers and also made clear that it would modify other rules affecting these policies. Among the waivers recently granted were for employers like Darden Restaurants, which operates the Red Lobster and Olive Garden restaurants, for 34,000 of its workers. Federal officials have granted 111 waivers to employers, insurers and union plans, who are responsible for covering about 1.2 million people. Darden said the waiver would allow it to offer employees access to affordable coverage as the health care law is started. Adding Clarity to Health Care Reform
Unfortunately, it is hard to have the popular features without some version of the mandate. A health insurance system cannot work unless most healthy people participate. The major source of uncertainty arises not from the bill itself, but rather from the lawsuits filed by states that object to the mandate. The legal issue is subtle, given that states have long imposed mandates of various kinds themselves, including those requiring children to go to school or requiring drivers to have liability insurance. So the states are not questioning the legality of mandates but whether it is constitutional for the federal government to foist one on state governments. The Supreme Court may make the ultimate decision in the next year or two. If it rules the mandate unconstitutional, the viability of the rest of the plan is not clear. Until the legal issues are settled, the status of health care reform will be uncertain. In this light, here are three thoughts about constructive steps we might take now: SEAMLESS ENROLLMENT The first step is not really a substitute for mandates, but rather a supplement to whatever system we adopt, including the law as now written. The goal of having nearly everyone insured requires two steps. We have to get most people to enroll, and we have to keep them enrolled even if they move in and out of the labor market. To address that second goal, we need to make it as easy as possible for people who lose jobs to remain insured. The setup I propose is that as soon as an employer submits a form notifying a laid-off worker that she has been dropped from its health insurance coverage, she would be automatically enrolled in a plan offered by her state insurance exchange, and directly billed at a rate that reflects her now-reduced income. Ideally, the default option would be an inexpensive, catastrophic policy that provides real insurance for major events. Of course, she could choose another plan, or she could opt out of insurance altogether, but she would have to take some specific action in order to do so. And once she landed another job, she would be automatically enrolled in a plan from her new employer, again with the ability to opt out. In a perfect world, all of this would be seamless, with one insurance ID number and no change in how claims are filed. If the Internal Revenue Service can keep track of you when you move from one job to another, the health care system should be able to do the same. FORFEITURE, NOT FINES After 2014, when the main components of health care reform kick in, the important question will be what happens to people who do not enroll initially, or do not stay enrolled. Under the current law, they will be fined an amount that depends on their income, payable when income taxes are filed. Fines are what differentiate a mandate from a suggestion. But fines are not the only way to give people an incentive to join. One alternative is based on a proposal by Paul Starr, the Princeton sociologist and health care expert. Instead of facing a financial penalty for not buying health insurance, people would lose some of their insurance rights. For a stretch of time — say, five years — people would no longer have the right to buy insurance at rates subsidized by the government, nor would they be protected from price discrimination based on pre-existing conditions. Under these rules, waiting until you become sick to buy insurance would have substantial risks. If the details are set properly, this arrangement could provide as big an incentive to join as a cash penalty. And because that cash penalty is imposed only when income taxes are due, the alternative plan may be easier to enforce.

She said it was critical to creating jobs through small businesses. “With all the money we’ve spent to help the economy, very little of it has filtered down to Main Street and family-owned businesses,” she said. The implication is that upon the death of an owner, estate taxes typically devastate small businesses and the jobs they provide. That is swill. Under today’s estate tax, which is retained in both the House version of the budget and in President Obama’s version, 99.8 percent of estates will never owe any estate tax. That’s because the tax applies only to estates that exceed $7 million per couple or $3.5 million for individuals, and a vast majority of American families are not and never will be that wealthy. Of the tiny number of estates that are taxable, almost none are small businesses. A new analysis by the Tax Policy Center found that under 2009 law, only 100 small businesses and family farms would owe any estate tax in 2011. And almost all such estates are able to pay the tax bill without having to sell business assets, according to a report by the Congressional Budget Office. The Lincoln-Kyl tax cut would raise the estate-tax exemption to $10 million per couple ($5 million for singles) and, in an even bigger giveaway to the superrich, lower the top rate from 45 percent to 35 percent. That sure would enrich the heirs of America’s biggest fortunes. It would not jump-start job creation on Main Street. In addition to Ms. Lincoln, other Democratic senators voting for the estate tax cut were Max Baucus and Jon Tester of Montana, Evan Bayh of Indiana, Maria Cantwell and Patty Murray of Washington, Mary Landrieu of Louisiana, Ben Nelson of Nebraska, Bill Nelson of Florida and Mark Pryor of Arkansas.
It’s a Tough Time for Tax Strategies
“I don’t think there’s anything more significant than the estate tax,” said Catharine V. Fairley, a tax planner and partner at Draper & McGinley in Frederick, Md., citing its wide implications for wills, gifts and trusts. “No one saw this coming — that they let the estate tax sunset.” Another unknown is what will happen to the large tax cuts of 2001 and 2003, enacted under President George W. Bush. The cuts produced current income-tax rates of 10 to 35 percent that are due to expire at the end of this year. While it seems a good bet that they will not be extended permanently, the Obama administration proposes to keep them in place, at least temporarily, for all but higher-income taxpayers. Individuals earning more than $200,000 — $250,000 for married couples — would revert to top-bracket rates of 36 and 39.6 percent, from today’s 33 and 35 percent. They would pay 20 percent on capital gains and dividends, instead of 15 percent. But the legislative outcome is highly uncertain. How much will Congress want to raise taxes, even on the rich, when economic recovery is so fragile and unemployment still near double digits? At the same time, the parlous state of the nation’s finances makes it likely that a variety of taxes must rise before very long. To recommend ways to cut budget deficits, the president has pledged to appoint a bipartisan panel to make recommendations, presumably after the midterm elections. “You’ve got to believe that future tax rates are going to be significantly higher than current maximum marginal rates — and that you’re going to be subject to them,” said Bruce J. Berno, president of Berno Financial Management, a financial planner in Cincinnati. And David A. Stockman, a former head of the Office of Management and Budget for President Ronald Reagan, predicted recently that “we’re going to be in the tax-raising business for the next decade.” The administration has already proposed a $90 billion “financial responsibility fee” — which some would call a tax — on banks, and reducing the value of itemized deductions and personal exemptions for the wealthy. Other possibilities that might be considered, but are rarely discussed openly, include full or means-tested taxation of Social Security benefits and applying the Medicare payroll tax to investment income. WITH the demise of the estate tax on Dec. 31, 2009, planning has become “a nightmare,” Ms. Fairley said. “It’s just limbo,” she added, until the government decides what to do about restoring the tax, which Democrats have said they support and which directly affects the existing gift tax and the way the capital gains tax is levied. “You have to wait and see” what happens, said Robert J. DiQuollo, president of Brinton Eaton Wealth Advisors in Madison, N.J. He noted the possibility of a drawn-out constitutional challenge if the estate tax were to be brought back retroactively to, say, Jan. 1. While those who sought abolition of the estate tax say it is unlikely that its repeal will be permanent, supporters of the tax don’t imagine that the exemption amount and rate will revert to the levels of 2001 — $1 million and 55 percent — when a convoluted phase-out was enacted. “Politically, that’s not feasible,” said Chuck Marr, director of federal tax policy at the Center on Budget and Policy Priorities. He supports the targets advocated by the Obama administration — a return to the 2009 regime, which would mean a $3.5 million exemption ($7 million for couples) and a 45 percent rate for larger estates. “I wouldn’t make any drastic moves” in anticipation of what might happen,” Mr. DiQuollo warned. He did suggest, though, that in coming months investors might want to “harvest” capital gains before the rate on them rises, perhaps even selling those qualifying for long-term treatment and buying them right back. The so-called wash sale rule applies only to losses.

HOME SWAP One of the central concerns in the early part of the financial crisis was homeowners’ ability to pay their mortgages. Now, the federal government is giving people a tax credit for buying a home. People who sell one home and buy another for less than $800,000 by April 30 (June 30 if you’re in contract) will get a $6,500 tax credit. There are four caveats to this: the total value of the house has to be under the limit (an $805,000 house would not qualify), the buyers’ adjusted gross income has to be less than $245,000 a year for a couple, they have to have lived in their previous home for five of the last eight years and the new home can’t be purchased from a family member. The credit started on Nov. 7, 2009. So if you swapped homes between then and the end of April and meet the other criteria, you qualify. CAPITAL GAINS The capital gains debate is an old one, but good to repeat. As the law stands now, the long-term capital gains rate is set to rise to 20 percent, from 15 percent, next year. Congress has plenty of time to change this, but last year the same was said for lawmakers’ ability to address to estate tax. “I view this as the last call to rebalance your portfolio at 15 percent,” said David Hamar, a managing director at Silvercrest Asset Management. “This has been around, but there are still people out there who haven’t done it.” One particular area where people may be stuck is incentive stock options. If the options are set to expire, you have to exercise them. And to get the long-term capital gains rate, you need to hold them for at least one year. The consolation is that even if the rate rises next year, it is still lower than the short-term capital gains tax, which is the same as ordinary income. GIFT TRUSTS In the run-up in the stock market, a wildly popular device for passing money to heirs tax-free was a grantor retained annuity trust, or GRAT. One of the main benefits of these trusts was their short duration, often two years. This allowed the wealthy to put something they believed would go up in value into the trust — from stock to a stake in a private company that was about to be sold — and name a child or other heir as a beneficiary. The appreciated amount would pass to the heir, while the original value of the asset and a small amount of interest would come back to the person who set up the trust. But on March 17, the House Ways and Means committee approved a bill that would increase the minimum length of a GRAT to 10 years. While there has been a lot of debate over the extension since President Obama took office, Don Weigandt, a managing director at J. P. Morgan Private Bank, said this change is part of a broader bill — the Small Business and Infrastructure Jobs Tax Act of 2010 — that is likely to pass. “We’ve been talking to a lot of clients about this, saying the time to be able to do GRATs in the most effective way is slowly leaking away from us,” he said. Those who want to set up a shorter-duration trust have only until the date of the bill’s enactment to do it. CHARITY The other trusts widely used during the boom were charitable remainder trusts. These allowed people to put an asset in a trust — usually a concentrated stock position — and receive an annuity from it. The benefit to the taxpayer was an immediate gift tax deduction and deferral of the capital gains tax on the securities, and charities knew they would eventually receive the principal. Those whose financial circumstances have changed, for better or worse, since setting up a charitable trust have a couple of options, said Jennifer Immel, senior wealth planner at PNC Wealth. One option for those who need money immediately is to “collapse” the trust. The asset would go directly to the charity and the grantor would receive back a sum equivalent to the present value of the future annuity stream. This would mean a higher tax bill, but it would give the grantor all the money now.

It was also cheap; the program costs $41.99 and includes other legal documents that complete the estate plan, including a health care directive and financial power of attorney. Quicken also asked how I wanted to pay estate taxes, something I couldn’t answer with confidence. It quickly became clear that anyone worried about these issues should consult a lawyer. And before you rule yourself out of that category, consider that the state estate tax is levied on assets above $675,000 in New Jersey and $1 million in New York. That could potentially affect middle-class families whose modest homes and retirement accounts have appreciated over several decades, or even someone with a large life insurance policy. LEGACYWRITER This was the only program that allowed me to account for future children. That may not apply to most people, but what happens if you want your grandchild — the one raised by your son’s former girlfriend — to be included? “My concern is not so much that it is in there, but who is going to explain it to you?” Ms. Twomey said. Taxes could also be a potential issue. The LegacyWriter will instructs that any inheritance-related taxes owed on most assets passing outside the will — like the I.R.A. or 401(k) — will be paid by assets passing through the will (perhaps a home). So if you leave your home to your children and forget to make them the beneficiaries of your I.R.A., they may end up paying any estate taxes owed on the I.R.A. “A lot of times, we would provide that taxes paid for property passing outside the will be paid from those assets,” Ms. Twomey said. Planning for Income and Estate Taxes in an Uncertain Time
Now, in the midst of a flurry of tax proposals, not to mention the Republican gains in the midterm elections, legislators have only five weeks to act on the estate tax before the holiday recess. And taxes — both the estate tax and the income tax — are far from the only issues on Congress’s agenda. Few tax planners and lawyers are willing to speculate on what will happen in the last months of 2010. They learned their lesson last year. But Alfred Peguero, a personal finance partner at PricewaterhouseCoopers, said his firm believed the weeks of Dec. 6 and 13 offered the best window for a decision on the estate tax. If Congress does not act, the estate tax will revert to its 2001 level — a 55 percent tax rate for individual estates larger than $1 million. This will force seven times the number of estates to file estate tax returns next year as in 2009, when the individual exemption was $3.5 million and the rate was 45 percent, according to a report from the Tax Policy Center, a Washington research group. The group said 108,000 estates would have to file returns under the lower exemption and 44,000 would pay tax, compared with 15,000 estate tax returns in 2009 with 5,500 owing tax. There are few concrete solutions to planning for something as uncertain as the time of death and Congressional action on taxes. But several accountants, lawyers and financial advisers offered a few suggestions on things to do before year-end. All carry risks. ESTATE TAX A year with no estate tax has led to a lot of macabre jokes about ending the life of an elderly relative. And much was made of two billionaires — George Steinbrenner and Dan Duncan — who died this year and whose estates will presumably go untaxed. But the absence of an estate tax for just one year and the lack of guidance from the Internal Revenue Service on how to handle other death-related taxes that could be owed this year has created another problem. Assets do not get valued at the date of a person’s death, as they would with an estate tax. Instead, heirs have to calculate the assets’ appreciated value and pay capital gains tax on that amount. There are provisions in the tax code to give people a limited amount of relief from taxes on capital gains. But the process is onerous and so far the I.R.S. has released only a draft version of Form 8939, which will be needed to file those taxes in April. Leiha Macauley, a partner in the individual clients group at Day Pitney, a law firm in Boston, has an even more complicated problem. In May, a client died with an estate worth some $20 million, which he had left to his wife through a simple will. His widow, however, is 93. Lawyers have drawn up the paperwork that would allow her to disclaim her husband’s property. It would then pass estate tax-free to her children. But they are waiting to file the paperwork to make sure she lives to the end of the year.
Courts Vow Legal Aid in Housing
The report, “Estate Planning: Dealing with Death and Taxes,” looked at estate planning online tools, resources and specialized services, as of last summer, at the various brokerage firms it tracks. According to David Rosenberg, senior analyst for brokerage firms at Corporate Insight, the top group of firms highlighted in the report include Fidelity, Merrill Lynch, Edward Jones, Charles Schwab, Wells Fargo Advisors and Ameriprise Financial. “These firms stand out from the others highlighted because they offer better mixes of estate planning services with online resources (e.g., articles, tools, information),” Mr. Rosenberg said in an e-mail. The other firms tended to offer either helpful online information or services from dedicated estate planning professionals rather than both. According to the report, two-thirds of brokerage firms that were tracked offer some form of estate planning services. And generally, most of the firms offering such services were full-service firms rather than discount brokerages. What firm and resources do you use for your estate planning needs and why?
Estate and Some Clarity, for Now
That cleared up a good deal of confusion: There was no estate tax at all for people who died in 2010, but if Congress hadn’t acted, the estate tax would have been reinstated this year at a $1 million threshold — $2 million for married couples — and with a top rate of 55 percent. The new thresholds are in effect through 2012. Yet for all the attention given to the estate tax, a less widely noticed change in the law could affect more families. That is the lifetime gift tax exemption, now also $5 million — or $10 million for married couples. While the estate tax exemption gradually rose from $1 million in 2002 to $3.5 million in 2009, the lifetime gift tax exemption had not budged from $1 million. Now that the gift tax exemption is back in sync with the estate tax exemption, families might rethink how they transfer wealth, said Jonathan Bergman, a financial adviser at the Palisades Hudson Financial Group in Scarsdale, N.Y. “When the gift tax exemption was so much lower than the estate tax exemption, it made it more advantageous from a tax perspective to give away your money after death,” Mr. Bergman says. “Now there’s just as much incentive” to give during your lifetime. And Susan Colpitts, co-founder of Signature, a wealth advisory firm in Norfolk, Va., said, “It’s an opportunity to see that money be used and appreciated by your beneficiaries.” People who had previously used up their $1 million lifetime gift tax exemption now can shift an additional $4 million out of their estates. Married couples who had exhausted their combined $2 million exemption under the old law can now shift an additional $8 million through gifts. (The $5 million gift tax exemption is separate from the gift-tax exclusion and allows anyone to make annual gifts to an unlimited number of people. For 2011, the maximum you can give one person without tax implications is $13,000.) Craig Janes, national director of estate gift and trust services at Deloitte & Touche, says he is advising his clients “to make very large gifts now” because it isn’t clear what might happen to the exemption in 2013 and beyond. Even if Congress were to roll back the gift tax exemption in 2013 to some level below $5 million and it did not grandfather gifts made in 2011 and 2012, gifts made today would still remove the future appreciated value of the gift from an estate. For example, if you left $5 million in your estate and it grew to $20 million, that $20 million that would be subject to applicable federal estate taxes. But if you were to give $5 million today, no matter how the gift is eventually treated for estate tax purposes, any future gains on the $5 million will be left out of your estate. The higher gift exemption has implications for many people. “Doctors, lawyers, hedge fund managers or anyone with a risk of malpractice has a tremendous opportunity to shield more of their estate by shifting up to $5 million into special trusts,” says Martin Shenkman, an estate lawyer in Paramus, N.J. He also views the higher gift exemption as a “golden opportunity” for same-sex couples, or other unmarried couples, to shift assets. At the same time, the new law also created some potentially costly pitfalls, with inadvertent disinheritance being the most glaring risk. Because the federal estate tax exemption has changed often in recent years, many lawyers have fallen back on using a “formula clause” in trust documents rather than stating that a specific dollar amount be left to certain individuals. For example, a typical formula clause might say: “I leave to my children the maximum allowable amount that is not subject to federal estate tax, with the remainder going to my second wife.” As recently as 2008, that meant your children would receive $2 million. Now the same trust document would leave those children $5 million. If the total value of your estate is $5 million or less, you have disinherited your second wife. When reviewing the formula clause with your lawyer, Mr. Shenkman suggests that you also toss in a sentence or two that spells out your general intent. Something like, “My intent is to give some money to my children but leave the bulk of my estate to my wife,” can help clarify matters. Another potential problem concerns the new “portability” feature that Congress added to simplify estate planning for married couples. Under the new law, surviving spouses can add to their estate the unused portion of a deceased spouse’s exemption. For example, if a deceased husband used $2 million of his $5 million in lifetime exemptions, the unused $3 million at his death could be moved to his wife’s estate. In the past, spouses could share their exemptions only by setting up trusts, which is no longer necessary.
Housing Market Looks Sickest today
In the last year, home prices in Seattle had a bigger decline than in Las Vegas. Minneapolis dropped more than Miami, and Atlanta fared worse than Phoenix. The bubble markets, where builders, buyers and banks ran wild, began falling first, economists say, so they are close to the end of the cycle and in some cases on their way back up. Nearly everyone else still has another season of pain. “When I go out and talk to people around town, they say, ‘Wow, I thought we were going to have a 12 percent correction and call it a day,’ ” said Stan Humphries, chief economist for the housing site Zillow, which is based in Seattle. “But this thing just keeps on going.” Seattle is down about 31 percent from its mid-2007 peak and, according to Zillow’s calculations, still has as much as 10 percent to fall. Mr. Humphries estimates the rest of the country will drop a further 5 and 7 percent as last year’s tax credits for home buyers continue to wear off. “We went into 2010 feeling gangbusters, thanks to Uncle Sam,” Mr. Humphries said. “We ended it feeling penniless, with home values tanking.” The fact that even a fairly prosperous area like Seattle was ensnared in the downturn shows just how much of a national phenomenon the crash has been. The slump began when the low-quality loans that drove the latter stage of the boom began to go bad, but the resulting recession greatly enlarged the crisis. Many people could not get a mortgage, and others simply gave up the hunt. Now, though the overall economy seems to be mending, housing remains stubbornly weak. That presents a vexing problem for the Obama administration, which has introduced several initiatives intended to help homeowners, with mixed success. CoreLogic, a data firm, said last week that American home prices fell 5.5 percent in 2010, back to the recession low of March 2009. New home sales are scraping along the bottom. Mortgage applications are near a 15-year low, boding ill for the rest of the winter. It has been a long, painful slide. At the peak, a downturn in real estate in Seattle was nearly unthinkable. In September 2006, after prices started falling in many parts of the country but were still increasing here, The Seattle Times noted that the last time prices in the city dropped on a quarterly basis was during the severe recession of 1982. Two local economists were quoted all but guaranteeing that Seattle was immune “if history is any indication.” A risk index from PMI Mortgage Insurance gave the odds of Seattle prices dropping at a negligible 11 percent. These days, the mood here is chastened when not downright fatalistic. If a recovery depends on a belief in better times, that seems a long way off. Those who must sell close their eyes and hope for the best. Those who hope to buy see lower prices but often have lighter wallets, removing any sense of urgency. Arne Klubberud and Melissa Lee-Klubberud paid $358,000 for a new, 960-square-foot townhouse on trendy Capitol Hill a few weeks after that Seattle Times article was published. Now, with one child and with hopes for more, they need more space. They just put the townhouse on the market for $300,000. “Obviously, this is not the ideal situation,” said Ms. Lee-Klubberud, a 32-year-old lawyer. They are hoping to take advantage of the sour market to buy at a good price, but first, they must sell for an amount that is acceptable. “Everyone has their limits,” she said. “We have ours.” On a dark, dank Sunday, a handful of people came to look at the three-level unit. One of them was Katherine Davis, who had just sold her house in the far eastern suburbs. It took 14 months, during which she had to drop the price several times. The equity she had accumulated over the decades disappeared quickly.
Apple Offers Subscriptions for Apps now player
Apple’s announcement appeared to do little to assuage those concerns at the nation’s three largest magazine publishers. All three — Time Inc., Hearst Magazines and Condé Nast — declined to say on Tuesday whether they planned to sell subscriptions under Apple’s new terms. “This is an important step, but it really needs to go further,” said Nina Link, chief executive of the Association of Magazine Media. “There’s probably some sense of frustration because publishers would like it to be more flexible. I think everybody realizes it’s early in the game and there will be other tablets that may have friendlier business terms and that this may evolve.” The new sales process could have implications beyond publishing, forcing companies like Amazon, Netflix and Rhapsody, the music subscription service, to share income with Apple for the first time. Under the new guidelines, they would be subject to the same 30 percent fee if the subscription — or in the case of Kindle books, a single title — is bought through the App Store, as many consumers are expected to do because they would not have to navigate to another Web site. Only if consumers buy subscriptions outside the App Store — for example, through the Web site of a magazine or Netflix.com — would the companies keep 100 percent of the sale price. Amazon and Netflix declined to comment. In a sharply worded statement, Rhapsody called Apple’s conditions “economically untenable.” In an interview, Jon Irwin, president of Rhapsody, said, “I would have no choice but to pull the app out of the App Store.” In the statement, Rhapsody said it would work with its “market peers in determining an appropriate legal and business response to this latest development.” Mr. Irwin declined to clarify what the company meant. Apple said that it would not allow discounting outside the App Store. A company must offer the same deals to customers buying through Apple as it does through its own Web site. Steven P. Jobs, Apple’s chief executive, said in a statement: “Our philosophy is simple — when Apple brings a new subscriber to the app, Apple earns a 30 percent share; when the publisher brings an existing or new subscriber to the app, the publisher keeps 100 percent and Apple earns nothing.” Another issue that will most likely prove problematic for those who sell iPad apps is that Apple will no longer allow links in apps that direct consumers to an external Web site where they can buy a subscription. Consumers who wish to buy directly from a site will have to find their way there themselves. As part of the new arrangement, publishers can provide free access to existing subscribers. This was a major concern for Time Inc., which had an arrangement with Apple to allow print subscribers to People to download the People iPad app free. A Time Inc. spokesman said that the company viewed Apple’s announcement as a positive step, but that it might not go far enough. “It seems like Apple is taking a step toward our position on subscription offerings,” said the spokesman, Keith Cocozza. “But the announcement also raises many questions around consumer data that we would need to work through and agree on.” Though Apple has agreed to share some data about subscribers with magazines — provided that subscribers consent when they make the purchase — publishing companies have been pushing for unfettered access to the information. Many in the publishing business feel that few consumers would willingly hand over that information, but Apple said the decision about whether to provide personal information would be up to consumers. “Publishers may seek additional information from App Store customers, provided those customers are given a clear choice and are informed that any additional information will be handled under the publisher’s privacy policy rather than Apple’s,” Apple said in its statement. On Tuesday at least two magazines, Elle and Popular Science, said they would begin selling subscriptions through the App Store. Elle is owned by Hachette Filipacchi and Popular Science by the Bonnier Corporation. Beyond economics, Apple’s tight control over subscriber data, its insistence on keeping 30 percent of the sale price and limiting consumers’ abilities to go outside an app to buy a subscription could raise antitrust concerns. “It is possible that regulators will look into them,” said Brian Pitz, an analyst with UBS. “And I think competition and pressure from others will push Apple to open up.”
Companies Warn That Higher Prices Are Looming
Cotton prices are near their highest level in more than a decade, after adjusting for inflation, and leather and polyester costs are jumping as well. Copper recently hit its highest level in about 40 years, and iron ore, used for steel, is fetching extremely high prices. Prices for corn, sugar, wheat, beef, pork and coffee are soaring. Labor overseas is becoming more expensive, meanwhile, and so are the utility bills to keep a factory running. “There are cost pressures from virtually everywhere,” said Wesley R. Card, the chief executive of the Jones Group, whose brands include Nine West and Anne Klein. After trying to keep retail prices flat or even lower during the recession, Jones says prices for its brands will climb 15 to 20 percent by autumn. When commodity prices started to rise last summer, many manufacturers and retailers absorbed the costs, worried that shoppers would not pay higher prices during the competitive holiday season or while the economy was still fragile. Many big companies, including Kraft, Polo Ralph Lauren and Hanes, say they cannot hold off any longer and must raise prices to protect some profits. Whether shoppers will pay is unclear. “Consumers are not exactly in the frame of mind or economic circumstances to say ‘Oh, pay whatever they ask,’ ” said Joshua Shapiro, chief United States economist at MFR Inc. “There’s going to be pushback.” Economists say the increases may eventually show up as inflation, though they are not yet projecting rates that would set off alarms. Despite some fears, inflation has been extremely low, at a rate of just 1.4 percent annually in December. Data for January will be released Thursday, but economists expect inflation will run about 2.5 percent this year. Some do see the creeping signs of higher inflation, and warn that the Federal Reserve will need to raise interest rates or at least stop pumping more money into the economy. Others argue that such moves would choke off economic growth sorely needed to get companies hiring again. For consumers, higher prices in stores means there will be a little less extra cash to spend. For companies, profits may be squeezed, making them a little less likely to invest in equipment or to hire aggressively. “One has to think about these higher prices not as a reason for economic activity to get derailed,” said John Ryding, chief economist at RDQ Economics, “but as a reason why the recovery is slower than might otherwise be the case.” Given that the price of a gallon of gas is now well over $3 on average, Americans may feel that they are already dealing with higher prices. Adding to the cost of food won’t greatly distort most household budgets. Food, gas, clothing, personal care products and cleaning and laundry supplies make up less than a quarter of household spending in the United States, according to government data. People at the bottom of the income scale struggle more as these prices rise, of course, because a larger share of their spending is on such essentials. To some, the prospect of modestly higher prices is no reason to worry. In fact, rising prices can indicate improving economic conditions. Greater demand from fast-growing countries like China has helped push up the costs of many raw materials — though officials there are worried about inflationary pressures, as are some officials in Europe. In the United States, the willingness of companies to raise prices shows they are feeling better about the domestic recovery. The sharp rise in commodity prices since last year has not translated into all new records. Food commodity prices are about 8 percent below the high in the summer of 2008, while energy prices are less than half their zenith. Prices of a basket of other commodities are about 4 percent below the heights of mid-2008.
Uses Force Against Protests as Region Erupts
The size of the protests in Iran was unclear. Witness accounts and news reports from inside the country suggested that perhaps 20,000 to 30,000 demonstrators in several cities defied strong warnings and took to the streets. The unrest was an acute embarrassment for Iranian leaders, who had sought to portray the toppling of two secular rulers, Zine el-Abidine Ben Ali in Tunisia and Hosni Mubarak in Egypt, as a triumph of popular support for Islam in the Arab world. They had refused permission to Iranian opposition groups seeking to march in solidarity with the Egyptians, and warned journalists and photographers based in the country, with success, not to report on the protests. Iranian demonstrators portrayed the Arab insurrections as a different kind of triumph. “Mubarak, Ben Ali, now it’s time for Sayyid Ali!” Iranian protesters chanted in Persian on videos posted online that appeared to be from Tehran, referring to the country’s supreme leader, Ayatollah Ali Khamenei. The Iranian authorities have shown that they will not hesitate to crush demonstrations with deadly force. Other governments across the Middle East and the Persian Gulf also moved aggressively to stamp out protests on Monday. In Egypt, the army stuck to its promise not to attack demonstrators, but the death toll during the protests leading to Mr. Mubarak’s downfall reached about 300 people, according to the United Nations and human rights organizations. Most fatalities appeared to have occurred when pro-government thugs attacked demonstrators. On Monday, the police in Bahrain fired rubber bullets and tear gas into crowds of peaceful protesters from the Shiite majority population. So much tear gas was fired that the officers themselves vomited. In Yemen, hundreds of student protesters clashed with pro-government forces in the fourth straight day of protests. In the central Iranian city of Isfahan, many demonstrators were arrested after security forces clashed with them, reports said, and sporadic messages from inside Iran indicated that there had also been protests in Shiraz, Mashhad and Rasht. Numbers were hard to assess, given government threats against journalists who tried to cover the protests. Aliakbar Mousavi Khoeini, a former member of Parliament now living in exile in the United States, said that 20,000 to 30,000 people had taken part across the country.
Perfect Menu. Now Change It.
When this new restaurant, Next, serves its first customers on April 1, its menu will be painstakingly reproduced from the classical French repertoire: whole lobes of foie gras baked in brioche, clear turtle soup with Madeira, duck pressed and sauced with its own blood and marrow, as served at the Tour d’Argent in Paris for more than 200 years. These dishes, which Mr. Achatz has been refining for a year, will be served for all of three months. Next will then morph into an entirely different restaurant, and again three months after that. Just to set the bar a little higher for himself, and make the creative process more invigorating, each menu for Next will draw from a different place and time. So, rather than the earthbound categories of Japanese, Italian or Peruvian, the food will evoke cloudier concepts: Kyoto in springtime; Palermo in 1949; Hong Kong in far-off 2036. A menu might be designed around a single day — say, the Napa Valley on Oct. 28, 1996, the day Mr. Achatz started work at the French Laundry, where he remained until 2001. Now 36, he is at the top of his profession, having achieved his lifelong ambition last fall when Alinea was awarded three Michelin stars. He has the sober perspective and what-the-hell attitude brought on by a near-death experience. His food at Alinea is already highly inventive; now, Mr. Achatz has set out to reinvent the restaurant itself. The idea for Next was planted on the grim night in 2007 that Mr. Achatz learned that he had an advanced form of oral cancer. Doctors told him he would have to have his tongue amputated, which would mean losing his sense of taste. Numb with shock, he pulled together a dinner of seared duck breast, morels, peas and stock from the walk-in at Alinea: comfort food for Nick Kokonas, his business partner, first groupie and close friend, who was devastated by the diagnosis. Mr. Kokonas, determined to appear upbeat, said it was the kind of strong and simple dish that they could build a new restaurant around when Mr. Achatz recovered. But Mr. Achatz dismissed the idea as not challenging enough, saying that he would be bored after three months. “Well then, every three months we’ll change it,” promised Mr. Kokonas, flooded with emotion and enthusiasm. The two of them — the spare, driven artist and the comfortable, fluid patron — evoke a modern Michelangelo and Medici, bonded by mutual trust and now locked into a very public artistic endeavor. With Next, Mr. Achatz is operating at a level of creative and financial freedom enjoyed by very few artists and only a handful of chefs in history. In the event of a Grant Achatz biopic, Mr. Kokonas, 42, a wealthy former derivatives trader and golf nut with flowing hair and interesting eyewear, could be played by a cleaned-up Johnny Depp. Mr. Achatz himself is a ringer for a red-haired Christian Bale. Mr. Kokonas also edited the massive Alinea cookbook (Ten Speed, 2008), and he and Mr. Achatz wrote the forthcoming book “Life, On the Line” (Gotham), which tracks Mr. Achatz’s history up to the advanced age of 34, when doctors declared him cancer-free. (Eventually, he found an oncologist who agreed to treat him with chemotherapy and radiation instead of surgery.)
